What did Google actually do?

The lawsuit alleged that Google Assistant activated without a wake word, recorded private conversations nearby, and used that audio data to serve targeted advertising. The recordings were allegedly shared with third parties and used without users’ knowledge or consent.

Google denied the allegations and settled without admitting wrongdoing. On January 26, 2026, Reuters reported that Google agreed to pay $68 million to resolve the class action. The settlement covers anyone who purchased a Google-branded device or was recorded by Google Assistant between May 18, 2016 and March 19, 2026.

This is a separate case from the YouTube Kids privacy settlement that closed in January 2026 and from any Google Play settlement. The official case name is the Google Assistant Privacy Litigation, and the administrator site is googleassistantprivacylitigation.com.

Who qualifies?

The settlement has two separate classes with different payouts:

Device Purchaser Class (higher payout)

You bought a Google-branded device in the US between May 18, 2016 and March 19, 2026. This includes:

  • Pixel phones (Pixel, Pixel 2, Pixel 3, and all subsequent models)
  • Google Home, Google Home Mini, Google Home Max
  • Nest Hub, Nest Hub Max, Nest Mini, Nest Audio
  • Any other Google-branded device with Google Assistant built in

Estimated payout: $18 to $56 per qualifying device, depending on total claims filed.

Privacy Class (smaller payout)

You were recorded by Google Assistant during the covered period but did not personally purchase a Google device. For example, if you were recorded in someone else’s home with a Nest device.

Payout is lower for this class and will depend on total claim volume.

How much will you get?

According to class counsel, device purchasers can expect approximately $18 to $56 per qualifying device. The WGN-TV report from June 9, 2026 noted that “for every qualifying Google device that you purchased, you will receive [a payment].” If you owned multiple Google devices during the covered period, you can claim for each one.

The exact amount depends on how many valid claims are filed by August 27. Class action payouts work on a pro-rata basis: $68 million divided among valid claimants. The fewer people who file, the higher each individual payment. Current estimates on Payout put the range at $20 to $500, accounting for low-to-high claim volume scenarios.

“It’s asking for my IMEI. Is this legit?”

Yes. A thread in r/ClassActionSettlement captured a common reaction when the settlement notice went out: “I started to fill it out but it wants the phones IMEI information. Is this legit?” (Thread: r/ClassActionSettlement)

The IMEI or serial number request is standard for this type of settlement. The administrator uses it to verify that you actually owned a Google device during the covered period and to prevent duplicate or fraudulent claims. The IMEI is a unique device identifier printed on the back of your phone or in Settings > About Phone > IMEI.

If you no longer have the device, check your Google account at myaccount.google.com under purchases and Google services. Your order history there may have the device model, and Google support can sometimes provide serial information linked to your account. You can also check old email receipts from Google Store.

If you cannot locate your device information, you may still qualify under the Privacy Class (no device required), which provides a smaller payment.

How to file your Google settlement claim

Filing takes about 5 to 10 minutes if you have your device information ready:

Identify which class you belong to

If you purchased a Pixel phone, Google Home, Nest Hub, Nest Mini, or any other Google-branded device between May 18, 2016 and March 19, 2026, you are a Device Purchaser. Otherwise, you may qualify under the Privacy Class.

Gather your device information

For the Device Purchaser Class, you will need the device model and likely the IMEI or serial number. Find this in your Google account order history at myaccount.google.com, in your device Settings under About Phone, or on the original packaging.

Complete the claim form

Enter your name, mailing address, email, and device information. For each qualifying device you owned during the covered period, you may receive $18 to $56. Submit before August 27, 2026.

Save your confirmation

Screenshot or save the confirmation email. The administrator will contact you when payments are distributed, typically 6 to 18 months after the claim deadline closes.

Why most Google device owners have not filed yet

The settlement was announced in late January 2026 and got solid coverage from Reuters and WGN-TV. Then coverage largely went quiet, and the claims period opened with nearly six months left on the clock. Most people who qualify have no idea this settlement exists.

A thread in r/classactions shows the pattern clearly: when the notice arrived, someone posted “Just got this in my spam folder, https://www.googleassistantprivacylitigation.com - Is this a new lawsuit?” (Thread: r/classactions) Settlement notices genuinely look like phishing emails to most people. The result is a real $68M fund with a fraction of eligible people filing claims.

The community in r/ClassActionSettlement flagged an important nuance: “This one is NEW and not to be confused with the other Google class action. The August 27 deadline is still roughly two months away, which is enough time to find your device IMEI and file. But two months goes fast when you are not tracking it.

What happens after you file?

After August 27, the administrator reviews all claims. Invalid or duplicate submissions get rejected. The remaining $68M fund is distributed among valid claimants on a pro-rata basis, with device purchasers receiving more than privacy class members.
