Payout Terms of Use

These Terms of Use ("Terms") govern your access to and use of Payout, including our mobile application, website, and all associated services and content (collectively, the "Services"). These Terms form a binding agreement between you and PAYOUT LLC ("Company," "we," or "us").

By using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

Eligibility

Payout is offered only in the United States. You must be at least 16 years old and reside in the United States or its territories to use Payout. By using the Services, you represent and warrant that you meet these eligibility requirements.

Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you (e.g., via app or email). Continued use of the Services after updates means you accept the revised Terms.

Accounts, Sign-In & Device Use

Payout offers an optional account so your settlement preferences sync across devices and so we can deliver push notifications when settlements you've saved go live. You may use the Services in any of three ways:

  • Signed in with Apple (iOS and web), via the native Sign in with Apple sheet on iOS or a browser-based Apple OAuth flow elsewhere;
  • Signed in with Google, via Google OAuth;
  • "Skip for now" — an anonymous session that lets you save settlement preferences and have them sync across reinstalls under a randomly generated account identifier that is not linked to your name, email, or any social account.

You are responsible for maintaining the confidentiality of any credentials associated with your sign-in provider and for all activities that occur under your account. You agree to provide accurate sign-in information and to keep it current. Notify us immediately at support@trypayout.app if you suspect unauthorized access to your account.

We may suspend or terminate your account at our discretion if we believe you have violated these Terms, abused the Services, or engaged in fraudulent, harmful, or unlawful activity.

You may close your account at any time via Settings → Delete Account in the mobile app, or by emailing support@trypayout.app with the subject line "Data Deletion Request." Closing your account permanently deletes your account record and the data we store on your behalf — see our Privacy Policy for details. If you signed in with Apple, deleting your account will also revoke the Sign in with Apple tokens issued to Payout, in accordance with Apple's account-deletion guideline.

You agree to use Payout in good faith and not to abuse the Service. We reserve the right to suspend access if abuse is detected.

Text Messaging (SMS)

If you sign in or verify your identity with a phone number, or otherwise provide us your mobile number, you agree that we (and our messaging provider, Twilio) may send you text messages to that number. These include one-time passcodes and account-security messages, which are transactional and necessary to use the Service, and — where you have opted in — occasional service or promotional messages about Payout.

Message frequency varies, and message and data rates may apply. You can opt out of promotional text messages at any time by replying STOP to any such message; reply HELP for help. After you reply STOP, we may send one confirming message. Opting out of promotional texts does not stop transactional passcode or account-security messages, which are required to sign in. Your consent to receive promotional text messages is not a condition of purchasing any goods or services.

Carriers are not liable for delayed or undelivered messages. You represent that you are the account holder or authorized user of the mobile number you provide, and you agree to notify us if that number is reassigned or you no longer use it. Standard message and data rates from your wireless carrier apply.

Use of Services

You may use Payout only for lawful, personal, and non-commercial purposes. You agree not to:

  • Violate any law or regulation
  • Submit false, misleading, or fraudulent information
  • Engage in spamming, scraping, or unauthorized data collection
  • Interfere with the functioning of the Services
  • Use automated tools or resell access without written consent

Intellectual Property

All content and functionality within the Services is owned by PAYOUT LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or use our content except as explicitly permitted.

Class Action Claim Services

Payout simplifies the process of filing class action settlement claims.

  • You do not need Payout to file a claim; you can submit it directly to the settlement administrator.
  • In connection with the class action settlements Payout helps you find, Payout is not a law firm and is not affiliated with, and does not represent, the law firms, settlement administrators, or courts involved in those settlements.
  • Payout does not provide legal advice and is not a law firm. For legal questions, consult an attorney.
  • We are not responsible for claim outcomes, processing timelines, or payments determined by third parties.

You are solely responsible for reviewing all information before submitting a claim. Payout is a document automation and submission tool. We do not interpret legal rights or represent you.

User Review & Accuracy of Claim Submissions

You must review all information on any claim prepared, generated, or submitted using the Services for completeness and accuracy before submission. You are solely responsible for the content of your claim and for determining your eligibility.

To the fullest extent permitted by law, PAYOUT LLC and Payout are not liable for any incorrect, incomplete, untimely, duplicate, or otherwise deficient claims, nor for any denials, delays, rejections, or payment outcomes arising from information you provide, your use of the Services, or actions of settlement administrators or other third parties.

Not a Law Firm; No Legal Advice

Payout is not a law firm and does not provide legal advice or legal services. Using Payout does not create an attorney-client relationship, and Payout is not your attorney. Any information made available through the Services is provided for general informational purposes only and should not be relied on as legal advice. For advice about your specific legal rights or situation, consult a licensed attorney.

Not a Financial Advisor; Affiliate Offers

Payout is not a bank, broker, or financial advisor and does not provide financial, investment, or tax advice. Any card, bank, investing, or similar options that Payout surfaces are third-party affiliate offers — Payout may be compensated when you sign up for or use them. More generally, Payout may have marketing, referral, or affiliate relationships with the third parties — such as financial institutions and other service providers — whose products, offers, or services it surfaces, and may be compensated for referrals, clicks, sign-ups, or approvals. These offers are not recommendations, endorsements, or financial advice, and you should evaluate them independently and review the third party's own terms before acting. Payout never holds, custodies, or takes possession of your funds.

No Guarantee of Payouts

Payout helps you discover settlements and prepare and/or submit claims, but eligibility and any award amounts are determined solely by the relevant settlement administrators, claims administrators, and/or courts — not by Payout. Payments are not guaranteed, amounts vary, and payment timing (often many months or even years) is outside Payout's control.

Many claims can typically also be filed for free directly with the settlement or claims administrator. Payout is a convenience tool that simplifies finding and filing claims; you are never required to use Payout to submit a claim.

Independent; Not Affiliated

Payout is independent. Except for the commercial marketing and affiliate relationships disclosed in "Not a Financial Advisor; Affiliate Offers" and in our Privacy Policy, Payout is not affiliated with, endorsed by, sponsored by, or acting on behalf of the companies, brands, courts, or claims administrators that are parties to or referenced in the class action settlements and listings we help you find. All product names, logos, trademarks, and brands are the property of their respective owners and are used for identification purposes only.

Your Responsibilities

You are responsible for the claims you submit through the Services. You must provide truthful, accurate, and complete information, and you may only file for settlements or funds that you genuinely believe you qualify for.

Submitting false, inaccurate, or duplicate claims may result in rejection by settlement or claims administrators, termination of your account, and possible legal consequences. Where applicable, you authorize Payout to help prepare and/or submit claims on your behalf using the information you provide.

Promotions, Sweepstakes & Referrals

From time to time Payout runs promotional sweepstakes, such as our weekly cash giveaway. These promotions are governed by their own Official Rules, which are incorporated into these Terms by reference and control in the event of any conflict with these Terms. No purchase or payment is necessary to enter or win, a purchase will not improve your chances of winning, and the promotions are void where prohibited. Promotions are open only to eligible U.S. residents who meet the age and eligibility requirements in the Official Rules.

You may earn additional entries by referring other people to Payout. Referral entries, stars, and any in-app credits have no cash value, cannot be redeemed for cash except as expressly described in a promotion's Official Rules, and may expire or be adjusted. You agree not to create multiple or fake accounts, refer yourself, use bots or automated methods, or otherwise game, manipulate, or defraud any promotion or referral program. We may disqualify entries, void rewards, and suspend or terminate accounts for any such abuse, in our discretion.

Winners may be required to verify their identity and eligibility and to complete tax documentation (for example, an IRS Form W-9) before a prize is awarded. Prizes are awarded "as is," and any taxes on a prize are the winner's responsibility; we may issue an IRS Form 1099 where required by law.

Privacy & Your Consent

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Payout, you consent to the collection, use, and (unless you opt out) sale or sharing of information as described in the Privacy Policy.

You may opt out of the sale or sharing of your information at any time in Settings within the app or at trypayout.app/donotshare.

Subscriptions, Fees & Auto-Renewal

Payout offers an optional Premium subscription that unlocks unlimited claim assistance. Subscriptions are sold and billed by the Apple App Store or Google Play (depending on your device), through our subscription management partner RevenueCat. Pricing, billing currency, and tax treatment are set on the app stores; check the in-app paywall or your device's subscription settings for the most up-to-date pricing.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your payment method on file with Apple or Google is charged at renewal. You can cancel or manage your subscription at any time:

  • iOS: Settings → [your name] → Subscriptions, or via the "Manage Subscription" link inside the Payout app.
  • Android: Google Play Store → Account → Payments and subscriptions → Subscriptions, or via the "Manage Subscription" link inside the Payout app.

In accordance with Cal. Bus. & Prof. Code §§ 17600 et seq. and similar laws, we provide clear renewal terms and cancellation instructions prior to renewal. Cancelling stops future renewals; it does not generate a prorated refund for the remainder of the current billing period.

Refund Policy

Subscription refunds. Because subscription billing is handled by Apple and Google, refund requests must be submitted directly to them — not to Payout — through reportaproblem.apple.com or Google Play Help. We have limited ability to influence app store refund decisions; we will support good-faith requests where possible.

Claim payments. We do not charge users to file individual settlement claims. Settlement payments are determined and distributed by the settlement administrator, not by Payout, and are not refundable by us.

If you initiate a chargeback without first contacting our support team, your access to the Services may be suspended or permanently revoked.

Data & Privacy

We collect and use your data in accordance with our Privacy Policy, which describes the information we collect through your account, your device, and our backend (provided by Supabase), and how we share it with our service providers.

You may delete your account and associated server-side data at any time from Settings → Delete Account in the mobile app, or by emailing support@trypayout.app with the subject line "Data Deletion Request" from the email address associated with your account.

Disclaimers

  • Payout is provided "as is", with no warranties of any kind.
  • We do not guarantee outcomes, claim eligibility, or payment amounts.
  • We are not responsible for delays, denials, or omissions by administrators or third parties.
  • While we strive to list accurate information, Payout does not guarantee completeness or continued availability of any settlement listings.

Taxes

You are solely responsible for any taxes associated with payments you receive from claim settlements.

Dispute Resolution & Arbitration

Most issues can be resolved without a formal dispute. Before starting arbitration or filing a claim, you and Payout agree to first try to resolve the dispute informally by emailing support@trypayout.app with a description of the issue and the relief requested. If the dispute is not resolved within 30 days after that email is sent, either party may begin arbitration or proceed in small claims court if the claim qualifies.

Except for disputes that qualify for small claims court or requests for emergency injunctive relief, you and Payout agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration under the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, unless the parties agree to another administrator. If the AAA is unavailable, the parties will work together in good faith to select a substitute arbitration provider, or a court may appoint one.

  • Class action waiver: To the fullest extent permitted by law, you and Payout agree that disputes may be brought only on an individual basis. Neither party may bring or participate in any class, collective, consolidated, private attorney general, or representative action, and the arbitrator may not combine claims or award relief beyond the individual claimant.
  • Jury trial waiver: To the fullest extent permitted by law, you and Payout waive the right to a trial by jury for disputes covered by this section.
  • Small claims: Either party may bring an individual claim in small claims court if the claim qualifies and remains only in that court.
  • Opt-out: You may opt out of this arbitration agreement within 30 days after first accepting these Terms by emailing support@trypayout.app with your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration.
  • Severability: If any part of this arbitration agreement or class action waiver is found unenforceable for a particular claim or request for relief, that claim or request will be resolved in court to the extent required by law, and the rest of this section will continue to apply.

Limitation of Liability

To the fullest extent permitted by law, Payout is not liable for any indirect, incidental, or consequential damages, including lost profits, even if advised of the possibility.

Indemnification

You agree to indemnify and hold Payout harmless from any claims, losses, or expenses arising from your use of the Services or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes not subject to binding arbitration shall be resolved exclusively in the state or federal courts located in California.

Miscellaneous

  • Force Majeure: We are not liable for delays due to events beyond our control.
  • Assignment: You may not assign your rights under these Terms without our prior written consent.
  • Entire Agreement: These Terms and our Privacy Policy represent the full agreement between you and Payout.
  • Severability: If any part is held invalid, the rest remains enforceable.
  • Waiver: Our failure to enforce a provision does not constitute a waiver of that right.

Payout helps users find and file settlement claims, but does not provide legal advice, represent users in any legal capacity, or process claim payments. All funds are handled by the class action administrator, and Payout does not guarantee eligibility, approval, or earnings.
