These Official Rules (the “Rules”) govern each weekly Payout giveaway. Each weekly giveaway is a separate and independent sweepstakes (each, a “Promotion”), with its own entry period, its own entrants, its own single prize, and its own drawing. Entries are valid only for the Promotion in which they are received; they do not carry over to any other Promotion and give you no chance of winning in any other week. References in these Rules to “the Promotion” mean the individual weekly sweepstakes in which you are participating. By entering, you agree to be bound by these Rules and by the decisions of the Sponsor, which are final and binding in all matters relating to the Promotion. Each Promotion is subject to all applicable federal, state, and local laws and regulations.

1. Sponsor

The Promotion is sponsored by PAYOUT LLC, 1968 S. Coast Hwy #4345, Laguna Beach, CA 92651 (“Sponsor”). The Sponsor is responsible for all aspects of the Promotion, including the awarding of prizes.

2. Eligibility

The Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old (or the age of legal majority in their state of residence, whichever is older) at the time of entry. Employees, officers, directors, and agents of Sponsor and its parent, affiliates, subsidiaries, and advertising/promotion agencies, and the immediate family members (spouse, parent, child, sibling, and their respective spouses) and household members of each such person, are not eligible. The Promotion is void in Puerto Rico, all U.S. territories and possessions, and outside the United States, and wherever otherwise prohibited or restricted by law.

3. Promotion Period

Each Promotion has a single entry period (its “Weekly Period”) that begins Monday at 12:00:00 a.m. Eastern Time (“ET”) and ends the following Monday at 12:00:00 a.m. ET, at which point that Promotion closes. Each Promotion is complete in itself: its entry period, its pool of entrants, its prize, and its drawing are independent of every other week. Entries received during one Weekly Period are eligible only for that Promotion’s drawing and are not carried forward. The total value of all prizes offered in each Promotion is one hundred fifty U.S. dollars ($150.00). Sponsor’s computer clock is the official timekeeper. Sponsor reserves the right to begin, suspend, modify, or end any Promotion, and to offer or decline to offer a Promotion in any given week, as described in these Rules.

4. How to Enter (No Purchase Necessary)

There are several ways to receive entries during a Weekly Period, all of which are free. No purchase or payment of any kind is required to enter or win, and a purchase or payment will not improve your chances of winning.

  • Free weekly entry: During each Weekly Period, tap “Enter” in the Payout app to receive one (1) free entry. Limit one (1) free weekly entry per person per Weekly Period.
  • Referral entries: You may receive additional entries when a new, eligible user redeems your referral code, and a new user who redeems a friend’s code may receive entries, as described in the app. Referral codes are personal and may not be sold, traded, posted to coupon/deal sites, or distributed through spam or any deceptive means.
  • Stars: You may exchange “Stars” earned for free within the app (for example, through daily check-ins) for additional entries at the rate shown in the app. Stars have no cash value, cannot be purchased, and cannot be redeemed for anything other than as expressly offered in the app. Stars are not entries: they give you no chance of winning until you exchange them for entries, and the entries you receive are eligible only for the Promotion open when the exchange is made.
  • Free mail-in entry (AMOE): No referral, share, exchange, or any other action or in-app activity is required to enter or to obtain additional entries. To obtain one (1) entry by mail, hand-print your full name, complete mailing address, email address associated with your Payout account (if any), and date of birth on a 3" × 5" card and mail it in a hand-addressed, stamped #10 envelope to: PAYOUT LLC, Weekly Giveaway AMOE, 1968 S. Coast Hwy #4345, Laguna Beach, CA 92651. Limit one (1) entry per mailing, but you may submit as many separate mailings as you wish; each mail-in entry must be mailed separately. There is no limit on the number of mail-in entries you may submit.

Equal odds. Each entry, regardless of the method by which it was obtained, has an equal chance of being selected in that Promotion’s drawing. Mailed entries must be postmarked during the applicable Weekly Period and received within five (5) business days after the close of that Weekly Period to be eligible for that Promotion’s drawing. Because each Weekly Period is a separate sweepstakes, a mailed entry that does not arrive within that window is void and is not carried into any other Promotion. Mechanically reproduced, illegible, incomplete, or late entries, and entries submitted in any manner other than as described in these Rules, are void.

5. Entry Conditions

Entries must be submitted by the eligible individual and may not be submitted on behalf of any third party. All entries become the property of Sponsor. Use of any automated system, bot, script, or other fraudulent or deceptive means to enter is prohibited and will result in disqualification. Limit one (1) Payout account per person; entrants found to be using multiple accounts, identities, or addresses to obtain additional entries may be disqualified. Sponsor is not responsible for lost, late, misdirected, incomplete, or undeliverable entries or communications, or for any technical or human errors that may occur in the processing of entries.

6. Prize & Approximate Retail Value

One (1) prize is available per Weekly Period: one hundred fifty U.S. dollars ($150.00) in cash, paid electronically. The approximate retail value (“ARV”) of the prize is $150.00. Prizes are fulfilled through Tremendous, Inc. (“Payment Provider”), a third-party payments platform. After a winner completes the claim process described in Section 9, the Payment Provider will send the winner an email at the address the winner provides, from which the winner selects how to receive the prize — options may include PayPal, Venmo, bank transfer (ACH), or a prepaid card, and are subject to the options the Payment Provider makes available at the time of redemption. The winner must have, or create, an account in the winner’s own legal name with the payout option they select. Delivery of the prize is subject to the Payment Provider’s own terms and privacy policy. Prizes are non-transferable and no substitution or cash equivalent is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value, or to use a different payment method or provider, if the advertised prize or payment method becomes unavailable. Limit one (1) prize per person per Weekly Period.

7. Odds of Winning

Odds of winning depend on the total number of eligible entries received during the applicable Weekly Period.

8. Winner Selection & Notification

For each Weekly Period, one (1) potential winner will be selected in a random drawing from among all eligible entries received during that Weekly Period. The drawing will be conducted on or about the Monday following the close of the Weekly Period by Sponsor or its designee, whose decisions are final. The potential winner will be notified using the contact information associated with their Payout account (or, for mail-in entrants, the email or mailing address provided) within a reasonable time after the drawing.

9. Winner Verification & Forfeiture

Notification will include a unique, single-use link to an online claim form (the “Claim Link”). To claim the prize, the potential winner must complete the claim form within seven (7) calendar days after notification is sent. The claim form requires the potential winner to provide their legal name, date of birth, mailing address, and an email address at which the prize can be delivered, and to accept an affidavit of eligibility and liability release (and, where permitted, a publicity release) electronically. Sponsor may also require a potential winner to verify eligibility by other reasonable means. The Claim Link expires when the seven (7) day claim period ends, and is void if shared, transferred, or used by anyone other than the potential winner.

If a potential winner cannot be contacted within a reasonable time, fails to complete the claim form or return any required documents within the claim period, provides information that cannot be verified, is found to be ineligible, declines the prize, or is otherwise disqualified, the prize will be forfeited and will not be awarded for that Weekly Period. Sponsor is under no obligation to select an alternate winner, and a forfeited prize goes unawarded rather than passing to another entrant. Sponsor reserves the right, in its sole discretion but with no obligation to do so, to conduct a replacement drawing for a Weekly Period in which a drawing was cancelled or conducted in error.

10. Taxes

All federal, state, and local taxes and any other costs associated with the acceptance or use of a prize are the sole responsibility of the winner. Where required by law, Sponsor or the Payment Provider may request tax documentation (for example, a completed IRS Form W-9) before or after a prize is released, and prizes totaling two thousand dollars ($2,000.00) or more to the same individual in a calendar year — or such other reporting threshold as the Internal Revenue Service may set — may be reported to the Internal Revenue Service on a Form 1099-MISC. A potential winner who does not provide required tax documentation within a reasonable time may forfeit the prize. Sponsor does not collect Social Security numbers or other taxpayer identification numbers through the claim form; if such information is required, it will be requested separately, by Sponsor or by the Payment Provider through the Payment Provider’s own process.

11. Publicity

Except where prohibited by law, acceptance of a prize constitutes the winner’s consent to Sponsor’s use of the winner’s first name, last initial, and state of residence for promotional purposes in connection with the Promotion, without further compensation, notice, or approval.

12. General Conditions; Right to Cancel or Modify

Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or the app, to be acting in violation of these Rules, or to be acting in an unsportsmanlike or disruptive manner. If, for any reason, the Promotion is not capable of running as planned — including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond Sponsor’s reasonable control — Sponsor reserves the right, in its sole discretion, to suspend, modify, or terminate the Promotion and to select a winner from eligible entries received prior to the action taken, or as otherwise deemed fair and appropriate by Sponsor. Any attempt to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law.

13. Limitation of Liability & Release

By entering, each entrant releases and holds harmless Sponsor and its parent, affiliates, subsidiaries, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt, use, or misuse of any prize, including without limitation personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy. The Released Parties are not responsible for any typographical or other error in these Rules or in the announcement or administration of the Promotion, or for any technical malfunction, network, hardware, or software failure, or for incomplete, garbled, or delayed transmissions.

14. Disputes & Governing Law

Except where prohibited, each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Promotion shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in the State of California. These Rules and all matters relating to the Promotion are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Entrants waive all rights to claim punitive, incidental, or consequential damages, and any damages other than out-of-pocket expenses.

15. Privacy

Information collected from entrants is subject to Sponsor’s Privacy Policy and will be used in connection with the administration of the Promotion. To deliver a prize, Sponsor shares the winner’s name and email address with the Payment Provider identified in Section 6.

16. App Stores

The Promotion is in no way sponsored, endorsed, administered by, or associated with Apple Inc. or Google LLC. By entering, each entrant releases Apple Inc. and Google LLC and acknowledges that any questions, comments, or complaints regarding the Promotion must be directed to Sponsor, not to Apple or Google.

17. Winners List

To request the first name and state of residence of a Weekly Period winner, mail a self-addressed, stamped envelope to: PAYOUT LLC, Weekly Giveaway Winners List, 1968 S. Coast Hwy #4345, Laguna Beach, CA 92651, within ninety (90) days after the close of the applicable Weekly Period.

18. Severability

If any provision of these Rules is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
