What is the Whole Foods Hot Cocoa Settlement about?

Whole Foods Market California, Inc. and Mrs. Gooch's Natural Food Markets, Inc. agreed to a $650,000 settlement resolving claims that 12-oz canisters of 365 Organic Hot Cocoa Rich Chocolate Flavor Mix and 365 Everyday Value Organic Hot Cocoa Rich Chocolate Flavor Mix sold in California contained non-functional slack-fill. Eligible class members who submit a valid claim will receive a pro-rata share of a $100,000 consumer fund (estimated around $2.90 per claim, subject to the number of valid claims). The deadline to file a claim is October 14, 2025. Eligibility, claim review, payment timing, and any payment amount are determined by the settlement administrator, court-approved terms, or applicable refund program. Payout does not administer the settlement, determine eligibility, or guarantee payment.
