What is the Tesla Idle Fee Settlement about?
The proposed settlement in Shenkman v. Tesla, Inc., Case No. RG21102833, resolves allegations that Tesla improperly charged Supercharger idle fees to certain California customers who bought vehicles with free lifetime Supercharging and disabled or threatened to disable Supercharger access when fees were unpaid. Tesla denies wrongdoing, and the Court has not decided who is right. Eligible class members may receive refunds of idle fees paid through the settlement date, $50 if an eligible vehicle was disabled for less than 30 days, or $350 if it was disabled for at least 30 consecutive days. Current owners may also receive non-cash relief, while former owners may elect a $10 payment. Class members need the LoginID and PIN from their notice, or must request them from the administrator. A separate claim is required for each eligible vehicle by September 25, 2026. Eligibility, claim review, payment timing, and payment amounts are determined by the settlement administrator and the Court. Payout does not administer the settlement, determine eligibility, or guarantee payment.
Who qualifies for the Tesla Idle Fee Settlement?
You may qualify for the Tesla Idle Fee Settlement if you meet the eligibility requirements below. Eligibility is finally determined by the settlement administrator, not by Payout.
- Received an eligible Tesla vehicle in California before 2016-12-16 and continued to own it after that date
- Were a citizen of California as of 2021-06-21
- The vehicle purchase agreement described the vehicle as “Supercharger Enabled,” “Supercharger Hardware,” or “Supercharger Hardware & Access”
- Use the LoginID and PIN from the settlement notice, or request them from the administrator
- Submit a separate Claim Form for each eligible vehicle by 2026-09-25
