The Banner Health class action settlement (McCulley v. Banner Health) resolves allegations that Banner Health embedded third-party tracking pixels — including Meta Pixel and Google Analytics tags — on its MyBanner patient portal web properties. The lawsuit alleged these pixels secretly transmitted patients' protected health information to Meta, Google, and other third parties without patient consent, violating multiple state privacy laws and HIPAA-related consumer protections. Banner Health has not admitted wrongdoing.

The settlement covers approximately 1,028,000 Banner Health patients who had a MyBanner patient account and logged in between June 1, 2020, and November 22, 2023.
