What is the AMEX Settlement about?
A $17.5 million class action settlement has been reached with American Express Company and American Express Travel Related Services Company, Inc. in Moskowitz v. American Express Co., No. 19-CV-566 (E.D.N.Y.). The lawsuit alleges that American Express anti-steering rules in merchant agreements prevented merchants from encouraging customers to use lower-fee cards, allegedly causing merchants to raise prices and resulting in non-Amex card users paying more. American Express denies wrongdoing. Eligible class members (as described in the notice) may submit a claim for payment; the website states that if you are in the Illinois non-rewards credit card class and want a payment, you must submit a valid claim form online or by mail by the deadline. Eligibility, claim review, payment timing, and any payment amount are determined by the settlement administrator, court-approved terms, or applicable refund program. Payout does not administer the settlement, determine eligibility, or guarantee payment.
Who qualifies for the AMEX Settlement?
You may qualify for the AMEX Settlement if you meet the eligibility requirements below. Eligibility is finally determined by the settlement administrator, not by Payout.
- Be a member of the Illinois non-rewards credit card class (Visa, Mastercard, or Discover general purpose credit/charge card with no rewards and no annual fee) as described on the settlement website/FAQs
- Used the eligible non-rewards credit card (or authorized user used it) to purchase a good or service from a Qualifying Merchant in Illinois during the applicable class period (generally January 29, 2016 to June 1, 2022 for Illinois) with billing address and purchase in the same state
- Submit a valid claim form online or by mail postmarked by 2026-05-19
