What is the Americold data breach settlement about?

The settlement resolves claims tied to Americold cybersecurity incidents on or about November 16, 2020, and April 26, 2023. The lawsuit alleges that the incidents exposed personal and protected health information belonging to current and former employees and job applicants. Americold denies the allegations and has not admitted wrongdoing.

Americold will pay $5.25 million into the settlement fund if the court grants final approval. After court-approved fees, administration costs, service awards, and credit monitoring costs, the fund will pay valid claims for documented losses and residual cash benefits.

Class members can request up to $25,000 for documented, unreimbursed losses connected to either incident. They can also request an estimated $100 if Americold notified them about one incident or an estimated $200 if it notified them about both. Those estimates may increase or decrease based on valid claims and the money remaining in the fund.

  • You are in the United States and Americold notified you that your private information was affected by its 2020 data incident, its 2023 data incident, or both.
  • The incidents involved current or former Americold employees and job applicants.
  • A residual cash claim does not require loss documentation, but the settlement administrator uses its records to determine whether you were notified about one incident or both.
  • A claim for up to $25,000 in unreimbursed losses requires reasonable documents connecting the loss to one or both incidents.
