What did Blue Cross Blue Shield actually do?
The case is In re: Blue Cross Blue Shield Antitrust Litigation MDL 2406, filed in 2013 in the U.S. District Court for the Northern District of Alabama. Plaintiffs alleged that 30+ Blue Cross Blue Shield member companies violated federal antitrust law by dividing the United States into exclusive territories and agreeing not to compete with one another across those boundaries.
Under the alleged arrangement, each BCBS company operated as the only BCBS insurer in its region. The lawsuit claimed this reduced competition in the health insurance market, kept premiums artificially high, and limited consumers’ ability to choose among plans. Blue Cross Blue Shield denied the allegations and did not admit wrongdoing as part of the settlement.
After years of litigation, the parties reached a $2.67 billion settlement on October 16, 2020. The deal also required BCBS companies to change their business practices, including allowing more cross-market competition. All appeals were resolved, clearing the way for payment distribution to begin in May 2026.
Who was eligible to file a claim?
The settlement covered two main groups of class members.
Individuals and Insured Group Members
- People who purchased or received health insurance through any BCBS company between February 7, 2008 and October 16, 2020
- Employees and dependents covered under insured employer group health plans
- Self-employed individuals with individual coverage during the class period
Self-Funded Accounts
- Large employers, unions, and other organizations that self-funded their health benefits through BCBS
- Their employees and covered dependents who had out-of-pocket health expenses
- A separate $120 million fund was allocated for this group
The claim deadline was November 5, 2021. Filing is closed. If you had qualifying BCBS coverage during the class period but did not submit a claim before that date, you are not eligible to receive a payment from this settlement.
How much will your BCBS settlement payment be?
Your payment is a pro-rata share of the settlement fund, calculated based on how much you paid in health insurance premiums or out-of-pocket costs during the class period relative to all other valid claimants. The $2.67 billion total breaks down like this.
Individual and Insured Group Fund: $1.78 billion
For individuals, self-employed people, and employees covered through insured employer group plans. Your share is proportional to your estimated premiums or out-of-pocket costs during the February 2008 to October 2020 class period. Longer coverage periods and higher premiums mean a larger share.
Self-Funded Account Fund: $120 million
For large employers, unions, and other entities that self-funded their health benefits, plus their employees and dependents. Distributed separately from the individual fund.
How much are people actually receiving?
With roughly 6 million valid claims filed, the math works out to about $333 per claim on average, according to reporting by IndyStar and Yahoo Finance. That average covers a wide range. Claimants who paid significant premiums over years of coverage receive more. Claimants who were covered for shorter periods, or through employers who paid most of the premium on their behalf, receive less. Threads on r/Insurance and r/ClassActionSettlement show claimants posting amounts from a few hundred dollars to over $1,000.
When will BCBS settlement payments arrive?
The settlement administrator began distributing payments on May 11, 2026, per the official settlement website and USA Today. Users in r/ClassActionSettlement confirmed receiving notification emails that month saying their payment was being processed.
Processing 6 million payments takes time. A payment that has not arrived yet does not mean your claim was denied. The administrator is working through the list in batches.
Check your email for messages from Analytics Consulting LLC or from a bcbssettlement.com address. If you elected direct deposit or a prepaid card when you filed, payments typically arrive faster than paper checks sent by mail.

What if you didn't file by November 2021?
If you had qualifying BCBS health insurance during the class period but did not submit a claim, you cannot receive payment from this settlement. Courts do not reopen filing after a settlement reaches the distribution stage, and Analytics Consulting LLC is not accepting late submissions.
The filing window was open from 2020 to November 2021. Many people who qualified never saw the notice. Settlement notices arrive as generic-looking mail or in emails that read like marketing. Short filing windows, obscure websites, and legal language are why settlements with 100 million eligible consumers sometimes collect only 6 million claims.
Missing this settlement does not mean missing the next one. There are currently more than 97 open class action settlements you can claim for free. Getting notified before deadlines close is the difference between collecting and finding out too late.
