What is the Google Web and App Activity Settlement about?
A federal jury in Rodriguez et al. v. Google LLC (Case No. 3:20-cv-04688-RS, U.S. District Court for the Northern District of California) found on September 3, 2025 that Google unlawfully collected app activity data from roughly 98 million smartphone and tablet users who had turned off their 'Web & App Activity' (WAA) and/or 'supplemental Web & App Activity' (sWAA) settings. Even with the settings off, activity in non-Google apps was still transmitted to Google between July 1, 2016 and September 23, 2024 through the Firebase SDK and Google Mobile Ads SDK embedded in third-party apps. The jury awarded $425,651,947 in damages to two nationwide classes — one covering Android users and one covering non-Android (e.g., iPhone) users. With court-ordered interest, the judgment totaled about $440.3 million as of March 2026, and interest continues to accrue. Google has asked the court to set aside the verdict and may appeal; a hearing on those motions and on class counsel's fee request is scheduled for August 27, 2026.
