Chantix Pfizer Carcinogen Class Action Settlement

What is the Pfizer drug safety settlement about?

The Chantix class action settlement (In re Chantix (Varenicline) Marketing, Sales Practices & Products Liability Litigation (No. II), Case No. 22-MD-3050, U.S. District Court for the Southern District of New York) resolves allegations that Pfizer knowingly sold Chantix tablets contaminated with N-nitroso-varenicline, an organic compound classified as a probable human carcinogen. The FDA recalled all Chantix tablets in the U.S. in September 2021 after testing confirmed the contamination. Plaintiffs allege Pfizer failed to warn consumers and continued to sell the drug despite knowing about the defect.

Pfizer denied wrongdoing but agreed to pay $44 million to settle the economic-loss claims brought by individual purchasers and third-party payors (insurers and benefit plans) who paid for the recalled drug. The settlement received preliminary court approval on June 1, 2026, with a final approval hearing scheduled for October 13, 2026. Each claimant's payment is calculated pro rata — based on what they personally paid for Chantix — and is capped at their documented out-of-pocket expenditure. The consumer pool represents up to 20% of the net settlement fund. No proof of purchase is required to submit a claim, though the settlement administrator may request supporting documentation in some cases.
