A class action lawsuit (Salisbury v. Costco Wholesale Corporation, Case No. 2:25-cv-02277) was filed November 14, 2025, in the U.S. District Court for the Western District of Washington. The complaint alleges Costco knowingly sold Kirkland Signature tequila products labeled '100% DE AGAVE' and '100% AGAVE AZUL' that actually contained significant levels of non-agave alcohol. Nuclear magnetic resonance testing reportedly found the Kirkland Blanco contained only 60–80% agave-derived ethanol, while the Reposado contained as little as 5–25% agave-derived ethanol—so low it may not even qualify as tequila under Mexican law. The 54-page complaint includes federal RICO Act claims alleging an 'Adulterated Tequila Enterprise.' The case is brought by Hagens Berman Sobol Shapiro LLP.
