A class action lawsuit (Zaimi v. Costco Wholesale Corporation, Case No. 2:25-cv-01076) was filed June 10, 2025, in the U.S. District Court for the Western District of Washington. On April 28, 2026, the court denied Costco's motion to dismiss, ruling the deception theory was plausible and allowing the case to proceed toward class certification.
